１．個人情報保護宣言
株式会社西インド会社（以下「弊社」といいます。）は、会員皆様へ安心・安全・信頼のサービスを提供するに当り、会員皆様の全ての個人に関する情報(以下「個人情報」といいます。)の取り扱いについて規定を定め、個人情報の適切な保護に努めてまいります。
２．個人情報保護方針
（１）弊社は、個人情報保護法及び通信の秘密に係る電気通信事業法の規定その他の関係法令を遵守します。
（２）弊社は、電気通信事業における個人情報保護に関するガイドライン（平成16年8月31日総務省告示第695号）を遵守します。
（３）弊社では取り扱うすべての個人情報に対し、適切な管理を行います。
（４）弊社で業務に従事するすべての者は、会員皆様をはじめとする各種個人情報を守り、その信頼に応えます。
（５）弊社は、情報への不正アクセス、情報の紛失、破壊、改ざん及び漏えいなどを防ぐため、必要かつ適切な安全管理措置を講じるとともにその改善に努めます。
３．個人情報の取扱について
（１）利用目的の特定
弊社では、取得した会員の氏名、住所、電話番号等の個人情報を下記の目的で利用します。
弊社のサービスの提供、会員の本人確認、料金の請求、お問合せ対応、弊社のサービス等の変更・休廃止の通知、弊社が提供する他サービスのお知らせ・各種イベント・キャンペーンの案内に利用いたします。
（２）個人情報の開示
弊社は、会員から自己に関する個人情報の開示の請求があった場合は、本人確認を行ったうえで、これに応じます。また、個人情報の内容の訂正等の申出があった場合も、速やかに対応いたします。
（３）個人情報の利用・提供
サービスを提供するために必要な範囲でお客さまの個人情報を取得し、取得目的の範囲内で利用・提供を行います。
（４）第三者提供
弊社は、個人情報を取得目的の範囲内で利用するとともに、適切な方法で管理し、個人情報の提供先とその利用目的を通知し承諾を得ることを行わない限り、第三者に個人情報を開示、提供しないものとします。ただし、次の場合はこの限りではありません。
弊社が行う個人情報の第三者提供は以下の通りです。
・刑事訴訟法第２１８条（令状による差押え・捜索・検証）その他同法の定めに基づく強制の処分が行なわれた場合。
・特定電気通信役務提供者の損害賠償責任の制限及び発信者情報の開示に関する法律第４条（発信者情報の開示請求等）に基づく開示請求の要件が充足された場合。
・生命、身体又は財産の保護のために必要があると弊社が判断した場合。

This Privacy Policy describes how we handle your personal information for our services on the Namaste foods websites. It applies generally to the the Namaste foods website and other related websites. Some the Namaste foods-branded websites or websites we operate may be governed by separate privacy policies.
By accepting the Privacy Policy and the User Agreement in registration, you expressly consent to our collection, storage, use and disclosure of your personal information as described in this Privacy Policy. This Privacy Policy is effective upon acceptance for new users and is otherwise effective on January 1st, 2007.

Marketing

We may combine your information with information we collect from other companies (such as demographic data) to improve and personalize our services. If you don't wish to receive marketing communications from us, simply indicate your preference once you sign-in on in, or by following the directions within the email.

Our primary purpose in collecting personal information is to provide you with a safe, smooth, efficient, and customized experience. You agree that we may use your personal information to:

・members of our corporate family to help detect and prevent potentially illegal acts and provide joint services; (Our corporate affiliates will market only to users who request these services.)
・service providers under contract who help with our business operations; (such as fraud investigations, bill collection, affiliate and rewards programs and co-branded credit cards)
・other third parties to whom you explicitly ask us to send your information; (or about whom you are otherwise explicitly notified and consent to when using a specific service)
・law enforcement or other governmental officials, in response to a verified request relating to a criminal investigation or alleged illegal activity; (In such events we will disclose name, city, state, telephone number, email address, User ID history, fraud complaints, and bidding and listing history.)
・other business entities, should we plan to merge with or be acquired by that business entity. (Should such a combination occur, we will require that the new combined entity follow this privacy policy with respect to your personal information. If your personal information will be used contrary to this policy, you will receive prior notice.)
Without limiting the above, in an effort to respect your privacy and our ability to keep the community free from bad actors, we will not otherwise disclose your personal information to law enforcement, other government officials, or other third parties without a subpoena, court order or substantially similar legal procedure, except when we believe in good faith that the disclosure of information is necessary to prevent imminent physical harm or financial loss or to report suspected illegal activity.
Using Information from Namaste Foods
Our Sites enable you to share personal and financial information in order to complete transactions. We encourage you to disclose your privacy practices and respect the privacy of other users. Your password is the key to your account. Use unique numbers, letters, and special characters and do not disclose your Namaste Foods password to anyone. If you do share your password or your personal information with others, remember that you are responsible for all actions taken in the name of your account. If you lose control of your password, you may lose substantial control over your personal information and may be subject to legally binding actions taken on your behalf. Therefore, if your password has been compromised for any reason, you should immediately notify Namaste Foods and change your password.
Security
Your information is stored on our servers. We treat data as an asset that must be protected and use lots of tools (encryption, passwords, physical security, etc.) to protect your personal information against unauthorized access and disclosure. However, as you probably know, third parties may unlawfully intercept or access transmissions or private communications, and other users may abuse or misuse your personal information that they collect from the Site. Therefore, although we work very hard to protect your privacy, we do not promise, and you should not expect, that your personal information or private communications will always remain private.
